Disclaimer

The Deposit payment and/or written agreement to hire Executive Tile and Glass  for the purpose of work means you agree with the following.


Pricing and notes on estimate are subject to gst unless otherwise specified.

Pricing in communications outside of the estimates/invoices (include but not limited to) text messages, emails… Are subject to gst unless otherwise specified.


Glass Installation that requires drilling into a new Piece shall be carried out by a qualified technician, a proper receipt should be obtained.


The following terms may be used,

-Piece, a piece otherwise referred to as (but not limited to) Project/Job/Tile work etc...

-Client, the name at the top right corner of the Estimates/Invoices


Client is solely responsible for any damages, alterations, or any other means of disturbing a curing/setting/live... (on going) work site and its contents. Labour, materials (tools if applicable) cost will be added to invoice and will be due with final balance. A $250 fee plus work required is billed at $120/hr plus materials. (Client is entirely responsible for any defects or alteration of ongoing work in between visits)


Pictures will be taken of work site before, during and after completion. These pictures are property of Executive Tile and Glass and will be used in the best interest of Executive Tile and Glass without interference. Please do not post pictures of the unfinished Piece. Please do not post pictures of the finished Piece until they have been posted on the Executive Tile and Glass Instagram/Facebook page. Please do not hesitate to contact us for further questions.


Demolition:

During demolition all precautions will be taken to ensure anything outside of the mentioned scope is not damaged.

There is always a risk with precision demolition, including but not limited to (cutting mosaics from existing tile feature, partial removal of tile Pieces...) The Client assumes all risk and cannot hold Executive Tile and Glass liable.


During Tile installation things like Baseboards, Doors, Door stops will often be removed for ease of access and install.


Outlet installation includes required hardware.

Outlets will be reinstalled by Executive Tile and Glass.


There is always a risk with demolition, including but not limited to (cracked baseboards, stripped hardware, hand marks...) The Client assumes all risk and cannot hold Executive Tile and Glass liable. It is strongly recommended to change your baseboards with the renovation, if the current baseboard is glued on replacement is a must.


Prep

Full Prep is assessed after (not limited to) all tile is removed, after fresh concrete pours… If additional inspections are required they will be indicated on the Estimate.

Inspection for;

-water damage

-Condition of substrate walls

-Condition and thickness Substrate floor, the use of a membrane may be required. Additional Floor thickness may be required.

-Any other Critical Juncture (a specific point needing to be seen but is hidden under layers, covers…)

Prep required for rebuild to be discussed and price agreed upon to continue, pricing will be reflected on the Invoice.

The Estimate is considered a Quote unless otherwise specified, the Quote is built around the agreed terms without variation. Please note any variations once entered into the contract (after deposit is paid) are subject to an Alteration Fee of $250 plus labour/material cost, terms are to be renegotiated at the time. If price of Quote is to increase client will be advised before commencing the Piece.


 A secondary deposit may be required and is to be paid before work recommences. 


Price valid for 1 calendar month to the day**.


**Deposits from both Residential & Commercial Clients are accepted to secure Contract Start date/Pricing.

Residential Deposits: Materials and a designated portion of the labour 

Commercial Deposits: Materials and a designated portion of the Labour


Residential;

-Non optional

-Deposit is not fully refundable and is subject to below terms.

-The deposit consists of materials, prep, designing...

-Unless the contract is broken by the contractor the labour portion of the deposit is forfeited and a 35% restocking fee will be applied to materials that can be returned.

-Final sale materials are non-refundable and will be left with Owner, all other materials are to be returned by Contractor.

-A final receipt will be provided.

-Payment schedule (if applicable) must be adhered to for work to be completed, contract listing multiple scopes need to be paid on completion of each individual scope.


Commercial;

-Same as residential with the exception of the restocking fee being 50%.



Late / No Payments

-Invoices are net 15 (commercial only)

-Invoices are due on completion (Residential only)

-A 5% (of subtotal)  or $100 (whichever is higher) admin fee will be charged at day 31 and an additional  5%  or $100 (whichever is higher) every 30 day block thereafter until the remaining balance is paid in full. Full payment must be made, partial payments will be subject to additional fees and other terms associated with late payment).

The additional fees will continue until paid in full or a written agreement is entered upon with its own terms and conditions.

-At day 45 unpaid invoice may be given to recovery agency and a Builders Lien will be applied.


Contractual terms to be added to the Estimate Notes before signing of any parties.


Permits are the responsibility of the client and client only, any fines resulting from failure to acquire a permit will be added to invoice and are to be paid by the client. Parking in the city, if parking is by permit only or registration of licence plate is possible it is the client’s responsibility to advise Executive Tile and Glass. Avoidable (including but not limited to) plate registration, permit for renovation including street use... parking tickets will be payable by the client.


If Tiles are provided by Client it is the sole responsibility of the client to ensure quantity of tile on site matches requirements outlined on Quote. 


Delays in completion from insufficient tiles on site (if for example Client requests that start date must be followed and a delay occurs due to a partial delivery of tiles...) will result in a $400 fee.


-Tile quality, colour match (potential for different lots and any other deficiency resulting from using clients tile...) is the sole responsibility of the client, since tile is provided by client tile is being installed as is as provided. Please ensure all the tiles are from the same lot, this can lead to an extremely expensive fix that is not covered under Warranty. 


Executive Tile and Glass is not responsible for mismatched tiles.

-When Executive Tile and Glass provides tile for a Piece lot numbers are verified, if any discrepancies with tiles (colour, sheen...) occur Client will be responsible for contacting manufacturer.


Residential Contract: Digital signature and/or Deposit payment will lock in the contract.

Commercial Contract: Digital signature and/or Deposit payment will lock in the contract.


Payments can be made via e-transfer to: Info@executivetileandglass.ca, or by cash.


Residential,

This document is legally binding once deposit is paid, or we have come to a verbal or handshake agreement. With the payment of the Deposit I (the client) forfeit all rights to bring a suit against (Contractor) for any reason. In return, I will receive (Construction). I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed.


Commercial,

This document is legally binding once all parties have signed, or have come to a verbal or handshake agreement. With the payment of the Deposit & Digital signature I (the client) forfeit all rights to bring a suit against (Contractor) for any reason. In return, I will receive (Construction). I will also make every effort to obey safety precautions as listed in writing and as explained to me verbally. I will ask for clarification when needed.

Time frames and contract standards to be added to notes before client signature of agreement.

Text & Email conversations of the Piece are considered part of the agreement.
